Part 1 · Consent

The foundation. Get this wrong and the rest doesn’t matter.

You have clear, documented consent before texting or auto-calling any client or lead. Consent is specific — the person agreed to hear from your agency, by text or call. For promotional or sales outreach, your consent language is written and explicit, not assumed. You keep a record of when and how each person opted in (date, source, exact wording shown).

Part 2 · Texting (10DLC & opt-outs)

How your business messages stay deliverable and compliant.

Your business texting runs on a registered 10DLC brand and campaign — not a personal cell. Every message identifies your agency by name. You honor STOP / UNSUBSCRIBE immediately and never message that person again. You respond to HELP with your agency name and a support contact.

Part 3 · Calling (DNC & TCPA)

Where most agencies carry hidden risk.

You scrub sales calls against the National Do Not Call Registry. You keep an internal do-not-call list and honor it permanently. You only call within allowed hours (generally 8am–9pm in the recipient’s local time). You know your state’s call-recording rules (some require everyone on the call to consent).

Part 4 · Records & disclosures

Proof matters when someone asks.

You can produce proof of consent for any contact on request. You have a published privacy policy and SMS terms that mention how you message clients. You don’t message purchased or shared lists without verifiable proof of consent. Your consent records are retained, not deleted when a client leaves.
